- Handle SARFAESI proceedings against default cases, including drafting and issuing Notices as per the SARFAESI Act.
- Manage symbolic and physical possession processes of secured assets as per SARFAESI Act provisions. Obtain Section 14 Orders from the District Magistrate (DM) and Chief Judicial Magistrate (CJM) courts.
- Conduct and oversee E-auctions and private treaty sales for disposal of secured assets. Coordinate collection and recovery visits, ensuring timely resolution of NPA accounts.
- Draft legally airtight public auction notices for seized properties. Ensure strict compliance with the Security Interest (Enforcement) Rules to avoid post-sale litigation. Maximize the recovery percentage against the total Outstanding Dues (POS) during mega-auctions.
- Prepare and maintain Management Information System (MIS) reports for recovery performance and case tracking. Liaise with vendors, advocates, and other stakeholders for efficient case management and compliance. Represent the organization in legal proceedings before the High Court, DRT, and DRAT.
- File and prosecute cases under Section 138 of the Negotiable Instruments (NI) Act and Section 25 of the Payment and Settlement Systems (PSS) Act.
- Achieve a minimum 45% settlement/resolution rate at the pre-trial or Lok Adalat stage.
- File Original Applications (OAs) in DRT for high-ticket loans. Defend the company against Securitisation Applications (SAs) filed by borrowers looking to stall auctions. 100% timely filing of replies/written statements in DRT to prevent stay orders on auctions.
- Verify original title deeds, sale deeds, allotment letters, and possession certificates. Maintain a 0% rate of 'Title Defect' claims post-disbursement.
- Conduct rigorous searches at the Sub-Registrar Office (SRO) and CERSAI portal. Identify existing mortgages, litigations, attachments, or government acquisitions. 100% of disbursed loans must have a clean CERSAI search report
