The primary purpose of this position is to oversee the management of financial affairs of incompetent beneficiaries of the Department of Veterans Affairs. To include conducting in-depth analysis, quasi-legal examinations, investigations, and financial assessments of inquiries pertaining to allegations of misuse. Protects the VA beneficiary and their estate by initiating actions to generate payment suspensions, resumptions, or terminations for appropriate situations (successor fiduciary appointment, failure of fiduciary to account, unauthorized expenditures, death, alleged misuse or whereabouts unknown).
Review of the beneficiary’s living situation, capacity of the beneficiary to handle funds, and other pertinent information. Ensure that the beneficiary is receiving the full range of benefits entitled, explaining the laws and regulations surrounding questions from the beneficiary and/or any deficits in the veteran's needs. Explains decisions made by the VA and communicates the reasons to the claimant for their decisions, orally or in writing. Conduct investigations involving misuse of funds; gather credible evidence using established investigatory methods, in order to make a determination of funds misuse and make referral of any findings to the Regional Counsel's Office. Make legal recommendations to reduce the role or remove fiduciaries who are discovered to be misusing funds, perform audits/accountings. Take appropriate action to avoid liability to the VA and restore funds to the beneficiary by taking action against the fiduciary including creating an overpayment, debt, or other action when misuse occurs. Advises on the right of appeals and assists claimants in making appeals.
