Description: In order to maintain regulatory compliance with the new surviving spouse
beneficiary election made by the SECURE 2.0 Act of 2022 (“SECURE 2.0”) to the
administration of Section 401(a)(9) Required Minium Distribution (“RMDs”) with respect
to qualified, 401(k), 403(b) and 457(b) plans, and IRAs, the following updates must be
made in 2023. Effective January 1, 2024, to the extent a plan does not otherwise
provide for a more rapid distribution to the spousal beneficiaries, if a deceased
participant’s sole beneficiary is his or her surviving spouse, the spousal beneficiary must
make an affirmative election in order to be treated the same as a participant for purpose
of the beneficiary RMD rules.
